Construction of National Stadium in Warsaw

Description of the project

The National Stadium in Warsaw is a multi-functional sports stadium, located at 1 Książę Józef Poniatowski Avenue, constructed in years 2008-2011 to replace the former Stadion Dziesięciolecia before Euro 2012 European Football Championship. It officially opened on January 29th, 2012 and has been awarded the 4th (highest) category in UEFA classification.

During sports events, the facility is able to hold 58 500 sports fans, and during music events – up to 72 900 people. The total cubic capacity of the stadium (excluding the roof) is more than 1 000 000 m3. The total area of the stadium is 203 920 m². The span of the extension roof is 240 x 270 m. The spire is at the height of 100 m above the field (112 m above the level of Vistula river). The stadium has the largest conference room in Warsaw which fits 1600 guests, and the office and shopping space is 25 000 m². An underground car park below has the capacity of 1765 cars.

The scope of performance

Due to low quality of the technical documentation, which was to serve as the basis for the works, delivered by the Employer, the Contractor hired the independent Experts and Specialists to examine it and to prepare claims.

Our Experts and Specialists rendered the following services in association with the dispute:

Preparation of claims concerning:

  • prolongation of the project implementation period
  • increase in costs associated with this prolongation
  • additional cost of acceleration of the project implementation and costs of decreased productivity

Within the framework of the claims prepared, the Expert assessed the quality of the design documentation and identified interruptions in the project implementation. A claim for prolongation of the project completion was supported by a detailed critical path analysis and analysis of delays using the methods: Time impact analysis / As built vs as planned. The Expert verified correctness of the calculations, conducting the earned value analysis using the EVM (Earned Value Method).

During the subsequent stage of the project, the non-confirmed claims of the Contractor, determined by the Expert, served as a basis for the court claim for payment, and a settlement reached by the Parties to the project.

Benefits to the Client:

Thanks to the claims prepared by the Expert, the Contractor was able to extend the project completion time by 5 months. In addition, the documents prepared by the Expert served as a basis for obtaining of a performance bond security amounting to PLN 160 million (in the court decision, documents prepared by the Expert as an independent entity were referred to). During the subsequent stage of the project, the non-confirmed claims of the Contractor, determined by the Expert, served as a basis for the court claim for payment, and a settlement reached by the Parties to the project (Employer, Guarantor, Contractor, Subcontractors), ending the settlement concerning the National Stadium.
