The investment involves the construction of a new coal-fired unit with a net electrical capacity of 90 MWe and a thermal capacity in process steam exceeding 250 MWt, including auxiliary installations and facilities. The project is being executed under the EPC (“turnkey”) formula.
The CAS team prepared an independent Expert Opinion for the Contractors’ Consortium (Polimex Mostostal S.A., Polimex Energetyka sp. z o.o., and SBB Energy S.A.). This Opinion served as the basis for concluding an annex and a settlement agreement to the Contract with the Employer regarding the “Construction of a coal-fired power unit in Puławy.”
Contract Extension – The expert analysis supported the negotiation of an annex to the agreement, extending the completion deadline to June 3, 2023.
Increased Remuneration – The cost component of the Opinion contributed to an increase in the Contract Price, resulting in a raise of the Consortium’s remuneration by PLN 35 million net.
Dispute Resolution – The independent opinion facilitated the conclusion of a settlement agreement, resolving key issues between the Parties.
The objective of CAS is to prevent disputes during various stages of project implementation and to resolve disputes through the specification of claims and defense against those claims.
